According to TMZ, the two camps have called a truce. Cruise's lawyers will not be counter filing for divorce in LA as they were planning to do earlier. Instead they will focus on amicably settling contentious issues revolving around the couple's 6-year-old daughter Suri Cruise - custody, child support and visitation - as well as division of their property.
The negotiations are reported to be 'calm' with possibility of an out-of-court settlement being reached in New York itself.
According to People magazine, settlement negotiations have been going on for a few days.
A source told the magazine, Cruise "doesn't want his family dragged through the mud."
"They both love their daughter."
Cruise's lawyer, Bert Fields, had on Friday, July 5, accused Holmes' legal team of "play[ing] the media."
Holmes was seen at her lawyers Allan Mayefsky and Michael Mosberg's offices on Friday and Saturday.
She filed for divorce in New York on June 28, noting in her filing that she and her former husband had been living in New York City for at least two years prior to the split.
She is looking to keep divorce proceedings in the Big Apple, reportedly because it will improve her chances of gaining sole legal custody of Suri Cruise.
Tom wants the divorce proceedings to be moved to Los Angeles in California, where courts frown on sole legal custody requests.
